FOALING SERVICE CONTRACT
This
certifies __________________________________, herein referred to as Mare Owner,
has engaged one foaling service at Bennett
Woodland Farms (“BWF”) for the 2009 breeding season for the following
mare:

1. A Foaling Fee of $400.00, which includes the use of any electronic Foal Alert
device by BWF, shall be paid by Mare Owner before Mare and/or foal leaves
BWF. All unpaid expenses will be payable
upon receipt of an invoice or before the Mare leaves BWF clinic, whichever is
first. BWF clinic requires 48 hours
advanced notice when the Mare Owner wishes to remove Mare from BWF. The Mare and/or foal shall be released ONLY
upon payment in full of all outstanding invoices.
2. A Photostat copy of the registration papers,
veterinarian’s health certificate, worming and immunization records and a
current Coggins test (within 6 months, if out of state) shall accompany the
Mare. If these are not presented upon
the Mare’s arrival, BWF’s veterinarian shall make proper tests and analysis of
the Mare at Mare Owner’s expense. Mare (and foal, if applicable) will be
periodically vaccinated and wormed as deemed necessary by the attending
veterinarian at Mare Owner’s expense.
3. The Mare Owner agrees that the Mare shall be
in a healthy condition and free from infection or disease. Any mare certified by the attending
veterinarian not to be, in his opinion, in such condition may not be accepted
by BWF.
4. BWF agrees to use judgment consistent with
recognized standards in care and feed and supervision of the Mare and/or
foal. BWF agrees to assume
responsibility for arranging veterinarian and farrier services as
necessary. BWF’s veterinarian will
administer medical care as deemed necessary for the health and safety of the
Mare and/or foal. Mare Owner agrees to
pay all such veterinarian and farrier expenses.
5. Both parties agree that Bennett Woodland
Farms, BWF, its agents, guests or employees are not liable for any injury,
escape, disability, death, sickness and/or accident including consequential
damages caused to the Mare and/or foal unless such death, sickness and/or
accident was by the willful and wanton negligence of BWF, and the Mare Owner is
not liable for any damage, death, sickness and/or accident including
consequential damages caused to employees, veterinarian, or another animal in
the care of BWF, whether or not caused by the Mare.
6. This contract is non-assignable and
non-transferable. Mare Owner is
responsible for all personal property taxes, if any, on the Mare. BWF recommends that Mare Owner carry full
insurance on the Mare and/or foal.

7. This Contract is entered into the State of

When
Mare Owner and BWF sign this Contract, it will then be binding on both parties,
subject to the above terms and conditions.
