EQUINE CARE & BOARDING CONTRACT

THIS EQUINE CARE/BOARDING CONTRACT made and entered into on this ______ day of ________________, 20______, is by and between Bennett Woodland Farms LLC, hereinafter designated “BWF,” and __________________________________________ hereinafter designated “HORSE OWNER,” whose Address is ______________________________________________________, Home Phone ______________________, Bus. Phone_______________________, covering the horse described as; Name _______________________________, Reg. No ______________, Sex __________, Age ________, Breed______________, Color __________________, hereinafter designated the “Horse”, subject to the following terms and conditions:

1. BWF agrees to keep the Horse in a stall _____ , mare motel _____, or pasture ______.

2. BWF agrees to care for the Horse in a good and husbandlike manner, feeding the Horse as follows:

Good quality Grass/Alfalfa hay & Strategy grain provided by BWF and any supplements provided by HORSE OWNER or Kerri DeKubber Show Horses.

3. BWF agrees to perform the following additional services: please circle if needed.

A. Noon feeding (specify) _____________________________ at an additional fee of $75.00/month.

B. Trailer parking at $20.00 per month.

3. Horse Owner agrees to show bwf proof that the horse is current on tetanus, sleeping sickness, influenza, negative coggins test (if from out of WA state) and is has no known medical condition, allergies or contagious disease.

4. HORSE OWNER agrees that the Horse will not leave BWF facilities until all monies due are paid in full to BWF, veterinaries, farriers, or any other providers of service, and BWF shall have a lien against the Horse and any other Horse related equipment, such as trailers, saddles and miscellaneous tack for the value of services rendered, and shall be entitled to enforce such lien according to Washington State Law.

5. BWF is not responsible for any farrier care associated with said horse with out prior arrangements being made with BWF or Kerri DeKubber Show Horses.

6. HORSE OWNER agrees to pay BWF for the foregoing facilities and services the sum of $________ per day/per month, payable in advance on the first day of each month. BWF agrees to provide boarding/equine care on a month-to-month basis commencing on the __________day of ____________, 20___. Partial months boarding shall be paid on a $_______per day basis, payment is due in advance. Equine care/boarding fees paid after 4:00 PM on the 5^th day of the month will be charged a late fee of $25.00.

8. HORSE OWNER agrees BWF or Kerri DeKubber Show Horses is the acting agent to authorize all normal veterinary and farrier work on a routine basis for breeding clinic clients/special client basis only (if client resides outside of Whatcom County), which the HORSE OWNER agrees to pay for such services.

9. Both parties hereto agree that in the event the Horse shall require the services of a veterinarian, BWF will make a reasonable effort to contact HORSE OWNER. In the event HORSE OWNER cannot be reached, BWF is hereby authorized, as agent for HORSE OWNER, (a) to call Dr. ___________________, D.V.M.; phone #________________ and should such person be unavailable, (b) to call any other licensed veterinarian of his or her choice. All fees charged by such veterinarian shall be the sole and exclusive responsibility of the Horse Owner, and no liability whatsoever on the part of BWF for such fees.

10. Both parties agree that BWF, its agents or employees are not liable for any injury, sickness, death or theft suffered by the horse during the term of this Agreement. HORSE OWNER fully understands the HORSE OWNER assumes all risks. HORSE OWNER agrees to hold BWF harmless from any loss or injury to said horse or any other horse or person or property caused by the horse of said HORSE OWNER. All costs connected with the equine care/boarding, including excessive physical damage to BWF property, or for any other reason which arises while the horse is on the premises of BWF, are to be born by the HORSE OWNER. In no event, shall BWF be held liable for an amount of monies in excess of any fees or consideration, which have been paid by HORSE OWNER to BWF in furtherance of this Agreement.

11. HORSE OWNER agrees to hold harmless, defend and indemnify BWF and/or any of BWF’s agents, contractors, employees for any claim or action resulting from any accident, injury, death, or property damage to any person, horse, or property arising from any horse related activity.

12. HORSE OWNER hereby acknowledges receipt and understanding of the current BWF Rules and Regulations. HORSE OWNER agrees that his/her guests and invitees will be bound to, and abide by, the Rules and Regulations and accepts responsibility for the conduct of his/her guests and invitees according to such Rules and Regulations. BWF may revise these Rules and Regulations at BWF’s sole discretion from time to time. HORSE OWNER agrees that any revision shall have the same force and effect as the current Rules and Regulations. Failure, as determined in BWF’s sole discretion, of HORSE OWNER or HORSE OWNER’s guests and invitees to abide by BWF’s Rules and Regulations may result in BWF declaring the HORSE OWNER in default hereunder and result in termination of this Agreement.

13. Notice of termination; default; removal of horse. Either party may terminate this Agreement given thirty (30) days notice to the other or after breeding services are rendered. In the event of “good cause”, BWF may terminate this Agreement with 48-hour notice. “Good cause” includes, but is not limited to, any breach of this Agreement, or failure to abide by BWF’s Rules and Regulations.

14. This contract is non-assignable and non-transferable. BWF strongly recommends that HORSE OWNER carry full insurance on the Horse. Insurance company:_______________________ policy #________________.

15. This Contract is entered into the State of Washington, and will be interpreted and enforced under the laws of that state. If any clause in this Contract is against State Law, then that clause shall be null and void.

16. This Contract represents the entire agreement between the parties. No other agreement or promises, verbal or implied, are included unless specifically stated in this written Contract. When HORSE OWNER and BWF sign this Contract, it will then be binding on both parties, subject to the above terms and conditions. The HORSE OWNER agrees to pay all costs, fees, and expenses in connection with enforcing this Contract including any expenses and attorney fees actually incurred in any conflicts with or in enforcing the terms herein.
